Canadian Freedom of Information Privacy Act and NetSolutions
I was wondering if any Canadians here have read their province's Freedom of Information and Protection of Privacy Act and are using NetSolutions. In BC, the Privacy Act states that "A public body must ensure that personal information in its custody or under its control is stored only in Canada and accessed only in Canada". The server for NetSolutions is located in Charleston in USA. So doesn't that mean if a Canadian donor donates through NetDonor and their information is stored in an American server, wouldn't this be in violation to the privacy act? Doesn't this also mean, if, Blackbaud was require to open up their server for the US government because they were subjected to the "National Security Letter' section of the Patriot Act, would that affect our Canadian donor?
I've contacted Blackbaud and they are looking into it but just wondering whether anyone has come across this? Would you write a blurb in your organization's online privacy policy to 'consent' their information are being held in an American server?
